Too many people think that divorce has to end in a bitter battle over marital property, custody, visitation schedules and spousal support. The truth is that every divorce in California can be subject to a process that promotes mediation and alternative dispute resolution. That means your lawyer will need experience in all areas of mediation and negotiating.

What Can Family Law Mediation Services Do for You?

Mediation is an option that avoids expensive, emotional litigation. If you are willing to communicate with your spouse, mediation is a less painful way to resolve your differences. In most cases, the settlement won't come back to haunt you because your spouse signs off on the marital settlement agreement (MSA).

At the law firm of Robert M. Garland, I have been providing divorce mediation services since I opened my California family law practice in 1993. From careful UCCJEA analysis involving jurisdiction with interstate custody matters, to reimbursement rights (Family Code 2640) when dividing marital property, I can help ensure all of the relevant issues and rights get addressed.

In my experience with custody and visitation matters it is always better if spouses work out their differences than live with a court order from a judge. The value of a mediated settlement is the lasting benefit and peace of mind, knowing that the animosity has been removed from the process and your ex-spouse isn't likely to fight for a change to an MSA in a year or two. The courts expect mediated settlements to be fair to both parties. Later trying to force a modification becomes more difficult.
